Update - Permit Extension Law
The Permit Extension Law (PA Act 46), which was passed by the General Assembly on July 6, 2010 has been updated by a “Notice of Applicability” filed on August 6th and published in the PA Bulletin August 7th. The Permit Extension Act originally had excluded NPDES permit extensions with discharges to surface waters classified as high-quality or exceptional-value waters. This recent Notice of Applicability states that " . . . Act 46 does not extend any of the NPDES permits administered by the Department or County Conservation Districts . . ." A more recent notice published in the PA Bulletin August 14, 2010 states that the PADEP is extending NPDES Stormwater Discharge from Municipal Separate Storm Sewer Systems (MS4's) for an additional 9 months.
The PADEP is currently completing a guideline to address the details of administering the Act. We recommend contacting the County Conversation District having jurisdiction for future updates regarding applicable permit applications and extensions.
