Permit Extension Act Signed by Governor Edward G. Rendell Into Law

On July 6, 2010, Governor Edward G. Rendell signed into law Senate Bill 1042 - the Permit Extension Act. This legislation provides much needed relief to Pennsylvania landowners and developers with stalled construction projects caused by the slow economy and the drastic decline in the real estate market. The Permit Extension Act allows certain permits, development approvals, and authorizations in effect since January 1, 2009, the possibility of an extension to July 1, 2013.

Of particular significance is the Pennsylvania Department of Environment Protection (PaDEP) Stormwater NPDES Permit. Prior to this new law, expired NPDES permits would only be re-issued by adhering to new regulations and design criteria which was not in effect when the permits were originally issued. For many projects in various states of construction it was problematic to redesign and change already installed stormwater facilities. This new law will allow construction to continue using the originally designed and permitted facilities.

Some noteworthy exceptions apply and are not subject to the automatic permit extension. Certain stormwater permits issued by the PaDEP such as approvals for discharges to surface waters classified as high-quality or exceptional-value waters during construction activities will not be covered under the new legislation. Additionally, approvals and permits issued for discharge compliance with federal law are still active.

Warrington, PA, — Kenneth E. Heydt, P.E., was elected as the firm’s new President during the March 18, 2010 Board of Directors meeting. Mr. Heydt will take over the position from James M. Graf, P.E., P.L.S., who will remain as Chairman of the Board of Directors. “I feel that with Ken's experience and leadership within both the Company and the community, he will continue to successfully expand the company while maintaining the quality of services that has made Carroll successful over the years,” said Mr. Graf.

Mr. Heydt began working for CEC in 1981 as an Environmental Planner. In 1988, he became the Manager of Environmental/Authority Department, which flourished because of his extensive experience with Act 537 planning, wasteload management, wastewater treatment plant design and operation, water supply and computer modeling of water systems. In 2000, he was promoted to Executive Vice President with expanded supervisory duties over the firm’s Authority/Municipal Services, Planning & Site Design, GIS and IT Departments. In addition to his supervisory and design responsibilities, Mr. Heydt also represents several municipal authorities within the five-county Philadelphia area. He also serves on the Executive Committee of the Bucks County Workforce Investment Board and chairs the System Performance/Operations Committee for the WIB. “I am honored and humbled by the Board’s confidence in my abilities to lead the firm. I look forward to continuing the excellent traditions of CEC.” said Mr. Heydt.
